Terms of Service
1. Acceptance of Terms
By accessing the website at streamhuts.com or engaging StreamHuts for managed hosting and web development services, you agree to be bound by these terms of service, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws.
2. Service Description
StreamHuts provides managed AzuraCast hosting, internet radio setup, maintenance, and custom web development services ("Services"). Services are provided in three primary tiers (Launch, Grow, Signature) and optional add-ons including Amazon Alexa Skill integration.
3. Fees and Payments
All setup fees for custom web development and Alexa Skill integration are strictly non-refundable once work has commenced. Monthly management and hosting fees are billed in advance and are subject to the terms of your specific service agreement.
4. Content & Licensing Responsibility
Clients are solely responsible for the content broadcasted through their managed radio stations. This includes, but is not limited to, securing and maintaining all necessary music performance licenses (e.g., BMI, ASCAP, SESAC, SoundExchange) and ensuring all broadcasted material complies with copyright laws. StreamHuts does not provide music licensing and will not be held liable for any copyright infringement by the client.
5. Service Uptime & Maintenance
While we strive for 100% uptime, managed hosting services are provided on an "as is" and "as available" basis. Periodic maintenance may be required, and we will make reasonable efforts to provide advance notice of any scheduled downtime.
6. Limitation of Liability
In no event shall StreamHuts or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on StreamHuts' website or services, even if StreamHuts or a StreamHuts authorized representative has been notified orally or in writing of the possibility of such damage.
7. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Texas, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
